KINCLUTCH Terms of Use
Effective 30 September 2026. This is the licence agreement for the KINCLUTCH app.
1. Who you are agreeing with
These terms are between you and Popquarry Productions Limited Liability Company, a Wyoming limited liability company at 30 N Gould St Ste N, Sheridan, Wyoming 82801 ("we", "us"). Using KINCLUTCH means you accept them. If you do not, do not use the app.
2. Who may use it
You must be 18 or over to hold an account, and you are responsible for what happens under it. KINCLUTCH is offered in the United States only.
3. What KINCLUTCH does, and what it does not do
KINCLUTCH keeps a private record of the people you give gifts to, researches gift options when you ask it to, shows you the retailer's own page so you can buy, and helps you track the gift through to delivery.
KINCLUTCH does not sell gifts and never buys anything for you. It is a research and organising tool. Every purchase is yours, made at a retailer, on that retailer's terms.
4. Purchases, price and automatic renewal
KINCLUTCH is free to download. Gift research is paid for with AI credits, which are sold through the App Store as one-time purchases. We do not currently sell a subscription. If we offer one, the following applies to it:
- Apple shows you the price, the length of the subscription period and the renewal terms before you confirm. Nothing is charged until you confirm.
- A subscription renews automatically, and keeps being charged, until you cancel it. It renews at the end of each period unless cancelled at least 24 hours before that period ends.
- Your App Store account is charged. We never see or hold your payment card details.
- If we change the price or the subscription terms, we will tell you in advance and you will have the chance to cancel before the change takes effect.
5. How to cancel, and refunds
A subscription, if you have one, can be cancelled at any time on your iPhone: Settings → your name → Subscriptions → KINCLUTCH → Cancel Subscription. Cancelling stops the next charge; you keep access until the end of the period you have already paid for. Because Apple takes the payment, Apple also handles refunds, at reportaproblem.apple.com. We cannot issue a refund for an App Store purchase.
California residents. California's Automatic Renewal Law applies to any subscription we offer. The price, the length of each period and the fact that it renews automatically are disclosed before you are charged; you consent to those terms at purchase; you can cancel in the same place you subscribed, from your iPhone, at any time; and we give you advance notice before any change to the price or the renewal terms, with the chance to cancel first.
6. AI credits
Credits pay for gift research. They are a limited, revocable licence to use a feature. They are not money, not stored value, and not property, and they cannot be redeemed for cash or transferred. Credit purchases are final.
Two things you should know: if a gift search fails and publishes nothing, it does not consume your credits; and credits do not expire on a clock, but any unused balance ends if your account closes, whether you close it or we do.
7. Records about other people
Most of what you put into KINCLUTCH is about someone else. By entering it you confirm that you have a genuine gift-giving relationship with that person and that you are entitled to record what you record. Do not use KINCLUTCH to build a file on someone you do not have that relationship with, to monitor anyone, or to record information you obtained improperly.
Gift research can surface things you did not expect about a person. You accept that we are not responsible for the personal consequences of what a profile or a suggestion reveals.
A person you have recorded may ask us what is held about them and ask us to delete it, as set out in the privacy policy. We may act on such a request.
8. Questionnaires, recipients and guardians
You can send someone a private questionnaire through an expiring link. Answering is always voluntary and the link stops working when it expires.
If the recipient is under 13, the app requires the questionnaire to be addressed to a parent or guardian, or to be answered together in person. It cannot be sent to the child to answer alone. If you are a parent or guardian answering, you confirm you are that child's parent or legal guardian and consent to the answers being used to choose a gift. Those answers are used only to choose a gift. They are never used for advertising and never passed to anyone for advertising.
9. Gift research is research, not a promise
Gift options are produced with the help of artificial intelligence and by reading retailer pages at the moment you ask. That means:
- An option may simply be wrong for the person. You know them; we do not. The judgement is yours.
- An option may be out of stock or gone by the time you click through.
- A price may have changed since we read it. The price that counts is the one the retailer shows at checkout.
- What we show you is evidence we gathered, not a warranty that it is correct. Check anything that matters before you buy, including anything touching an allergy or a safety concern.
10. Buying from a retailer
When you choose an option, we hand you to the retailer. The purchase is between you and that retailer. We are not the seller, not their agent, and not a party to it. Delivery, returns, warranties, recalls and disputes are theirs. Delivery tracking in the app is a convenience for something you bought elsewhere; it is not a promise about arrival.
11. What you put in
What you write stays yours. You give us only the permission we need to store it, show it back to you and run the features you ask for. Nothing broader.
12. Acceptable use
Do not break the law with KINCLUTCH, monitor or profile people you have no gifting relationship with, try to break or overload the service, scrape it, resell its research, or use it to send anyone unwanted messages.
13. Our part
The app, its research method, its content and the KINCLUTCH name are ours. Using the app does not transfer any of that to you.
14. Disclaimer
The app is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that gift research will be accurate, complete, available, or suitable for any particular person or occasion.
15. Limit of our liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost opportunity or a gift that disappointed. Our total liability for any claim relating to KINCLUTCH is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars.
Some states do not allow some of these limits, so parts of the two sections above may not apply to you. Nothing here limits liability that cannot lawfully be limited.
16. Ending it
You can stop using KINCLUTCH and delete your account at any time from inside the app. We may suspend or end an account that breaks these terms or the law. When an account closes, the information we hold for it is deleted and any unused credit balance ends.
17. Governing law
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute may be brought in the state or federal courts located in Wyoming, and we each agree to that. If the law where you live gives you a right to bring a claim locally, this does not take it away.
18. Changes to these terms
We may update these terms. The effective date at the top shows the current version, and where a change materially affects you we will tell you in the app before it takes effect. Changes to price or subscription terms always come with advance notice and a chance to cancel.
19. If you got the app from Apple
These terms are between you and us, not Apple, and we alone are responsible for KINCLUTCH.
- Your licence is a non-transferable licence to use KINCLUTCH on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide any maintenance or support for KINCLUTCH.
- If KINCLUTCH fails to conform to any applicable warranty, you may tell Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation at all, and any other claim is our responsibility.
- We, not Apple, handle any claim that KINCLUTCH does not conform to a legal requirement, any product liability claim, and any claim that KINCLUTCH infringes someone's intellectual property.
- You confirm you are not in a country subject to a United States embargo or designated as supporting terrorism, and that you are not on any United States list of prohibited parties.
- You must comply with any applicable third-party terms when using KINCLUTCH.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- For any question about KINCLUTCH, contact us at support@kinclutch.com.
20. General
If part of these terms is unenforceable, the rest still stands. Our not enforcing something once does not waive it. You may not transfer your account; we may transfer these terms if the business is sold. These terms, with the privacy policy, are the whole agreement between us about KINCLUTCH. You agree we may communicate with you electronically.
